Probate is the process of identifying whether a decedent left a properly executed and valid will, appointing a personal representative, providing notice to creditors and potential heirs, gathering the assets of the estate, paying valid creditors, and then distributing the remaining balance to the estate's beneficiaries.
If that sounds like a hassle, that is because it is. Probate is often be a daunting and overwhelming task for many people who have just lost a loved one. Unfortunately, probate is often required to transfer assets from the decedent to his or her beneficiaries. It is a time consuming (usually 6-12 months) and detail oriented process that requires a lot from the Personal Representative.
